2. Scope and who this policy applies to
2.1 This Acceptable Use Policy ("AUP") applies to all NovaMX services offered through novamx.eu, the customer portal (my.novamx.eu), and related infrastructure operated by NovaMX B.V. in the European Union.
2.2 It covers customers, account holders, authorised portal users, mailbox users, website operators, and anyone who uses a domain, hosting package, e-mail service, CDN, mail-security product, or API connected to a NovaMX account.
2.3 By ordering, registering, or using NovaMX services, you agree to this policy together with the Terms, the Privacy Notice, the Portal Access Policy, the Service Levels document, the Abuse Policy, and the Notice-and-Take-Down procedure.
2.4 NovaMX B.V. has signed the Dutch sectoral Gedragscode Abusebestrijding (Clean Networks). How we handle abuse reports is set out in the Abuse Policy. How we handle reports of allegedly unlawful content is set out in the Notice-and-Take-Down procedure. Those documents are public at novamx.eu. This is not a certification claim.
3. Description of services
3.1 NovaMX provides domain registration and transfer, DNS and DNSSEC management, web and e-mail hosting, mail security and deliverability tools (including SPF, DKIM, DMARC, and related monitoring), CDN and edge protection, backups, customer self-service through the portal, and optional add-on services as described on the NovaMX website and in the applicable order confirmation.
4. Permitted use
4.1 You may use NovaMX services only for lawful business or personal purposes that comply with this policy and applicable law. Permitted use includes operating legitimate websites and applications, business e-mail, domain portfolio management, mail authentication and security monitoring, and normal customer support interactions with NovaMX.
5. Prohibited use
5.1 You must not use NovaMX services to:
publish, store, transmit, or link to illegal content;
distribute malware, ransomware, spyware, or unauthorised access tools;
send unsolicited bulk e-mail (spam) or operate phishing, fraud, or impersonation schemes;
infringe intellectual property or privacy rights;
harass, threaten, or defame others;
facilitate terrorism, violent extremism, or exploitation;
circumvent security controls on NovaMX or third-party systems;
launch or relay denial-of-service attacks or port scanning from NovaMX infrastructure;
mine cryptocurrency or run resource-intensive workloads without prior written approval where they affect shared infrastructure;
resell or sublicense services in a way that bypasses NovaMX account controls; or
use services in any manner that damages NovaMX, other customers, or the reputation of NovaMX's IP ranges.
6. High-risk and restricted activities
6.1 Activities that require prior written approval from NovaMX include: bulk mailing above your package limits; high-volume transactional mail; file storage or proxy services primarily for third parties; adult content; gambling where licensing is required; financial services subject to sector regulation; and any use that materially increases abuse or deliverability risk.
6.2 NovaMX may refuse or suspend such use even if it is not strictly prohibited elsewhere in this policy.
7. Legal and regulatory compliance
7.1 You must comply with applicable laws and regulations in the Netherlands, the European Union, and any jurisdiction where your content or recipients are located. This includes data protection law (GDPR), electronic communications rules, consumer protection where applicable, intellectual property law, and export control and sanctions regulations.
7.2 You may not use NovaMX services for the benefit of persons, entities, or countries subject to EU, UN, US, or other applicable sanctions where providing the service would violate those restrictions.
8. Customer content and third parties
8.1 You are responsible for all content, DNS records, e-mail, applications, and data placed on or sent through your NovaMX services, including content uploaded by your employees, contractors, end users, or anyone with access you provide.
8.2 You must ensure that sub-users and third parties acting on your behalf comply with this policy. NovaMX is not responsible for customer-generated content but may act when abuse is reported or detected.
9. Security and abuse prevention
9.1 You must maintain secure credentials, apply timely security updates to software you manage, and configure DNS and mail authentication responsibly.
9.2 You must not attempt to probe, scan, or compromise other systems from NovaMX infrastructure. Report suspected compromise or abuse involving your account to NovaMX promptly at abuse@novamx.eu or through the customer portal.
10. Monitoring and enforcement
10.1 NovaMX may monitor service usage, network traffic metadata, abuse reports, mail reputation signals, and public DNS data to protect infrastructure, comply with law, and enforce this policy. NovaMX does not guarantee continuous content review of all customer data.
10.2 When NovaMX identifies or reasonably suspects a violation, it may: warn the customer; require remediation; filter or block traffic; rate-limit services; suspend domains, hosting, mail, or portal access; withhold registration or transfer actions; terminate services; and report activity to registrars, CERT teams, hosting peers, or competent authorities where required or appropriate.
11. Suspension and termination
11.1 NovaMX may suspend or terminate services immediately for serious violations, legal compulsion, court orders, registrar policy, payment default combined with abuse risk, or repeated minor violations.
11.2 Where reasonable, NovaMX will attempt to notify the account holder and allow time to cure non-urgent issues. Refunds after termination for cause are handled according to the Terms and applicable law.
12. Changes
12.1 NovaMX may update this policy to reflect legal, technical, or product changes. Material updates are published under a new version identifier. Continued use of services after publication constitutes acceptance of the updated policy unless otherwise required by law.

15. Governing law and language
15.1 This policy is governed by the same law and dispute forum as the NovaMX Terms.
15.2 The English text of this policy is authoritative. The Dutch text is provided for convenience; in case of conflict, the English text prevails.
2.1 Dit Acceptable Use Policy ("AUP") geldt voor alle NovaMX-diensten via novamx.eu, het klantportaal (my.novamx.eu), en gerelateerde infrastructuur van NovaMX B.V. in de EU.
2.2 Het is van toepassing op klanten, accounthouders, geautoriseerde portaalgebruikers, mailboxgebruikers, websitebeheerders, en iedereen die een domein, hostingpakket, e-maildienst, CDN, mailbeveiligingsproduct of API via een NovaMX-account gebruikt.
2.3 Door te bestellen, te registreren, of diensten te gebruiken, gaat u akkoord met dit beleid samen met de Voorwaarden, de Privacyverklaring, het Portaaltoegangsbeleid, het document Serviceniveaus, het misbruikbeleid en de notice-and-take-down-procedure.
2.4 NovaMX B.V. heeft de Nederlandse sectorale Gedragscode Abusebestrijding (Clean Networks) ondertekend. Hoe we abusemeldingen behandelen staat in het misbruikbeleid. Hoe we meldingen over vermeend onrechtmatige inhoud behandelen staat in de notice-and-take-down-procedure. Die documenten zijn openbaar op novamx.eu. Dit is geen certificeringsclaim.
3. Dienstbeschrijving
3.1 NovaMX levert domeinregistratie en -verhuizing, DNS- en DNSSEC-beheer, web- en e-mailhosting, mailbeveiliging en deliverability-tools (waaronder SPF, DKIM, DMARC en gerelateerde monitoring), CDN en edge-bescherming, back-ups, klant-selfservice via het portaal, en optionele add-ons zoals beschreven op de NovaMX-website en in de toepasselijke orderbevestiging.
4. Toegestaan gebruik
4.1 U mag NovaMX-diensten alleen gebruiken voor rechtmatige zakelijke of persoonlijke doeleinden die passen bij dit beleid en de wet. Toegestaan gebruik omvat onder meer legitieme websites en applicaties, zakelijke e-mail, domeinportefeuillebeheer, mailauthenticatie en beveiligingsmonitoring, en normaal contact met NovaMX-support.
5. Verboden gebruik
5.1 U mag NovaMX-diensten niet gebruiken om:
illegale content te publiceren, op te slaan, te verzenden of naar te linken;
malware, ransomware, spyware of ongeautoriseerde toegangstools te verspreiden;
ongevraagde bulk-e-mail (spam) te versturen of phishing-, fraude- of impersonatieschema's te exploiteren;
intellectueel eigendom of privacyrechten te schenden;
anderen te intimideren, bedreigen of belasteren;
terrorisme, gewelddadig extremisme of uitbuiting te faciliteren;
beveiligingsmaatregelen van NovaMX of systemen van derden te omzeilen;
denial-of-service-aanvallen of portscans te starten of door te geven vanaf NovaMX-infrastructuur;
cryptocurrency te minen of resource-intensieve workloads uit te voeren zonder voorafgaande schriftelijke toestemming wanneer dit gedeelde infrastructuur raakt;
diensten door te verkopen of in sublicentie te geven op een manier die de accountcontroles van NovaMX omzeilt; of
diensten op een manier te gebruiken die NovaMX, andere klanten, of de reputatie van de IP-reeksen van NovaMX schaadt.
6. Hoog-risico en beperkte activiteiten
6.1 Activiteiten die voorafgaande schriftelijke toestemming van NovaMX vereisen, zijn onder meer: bulkmail boven uw pakketlimieten; hoogvolume transactionele mail; bestandsopslag of proxydiensten primair voor derden; adult content; gokken waar vergunning vereist is; financiële diensten onder sectorspecifieke regelgeving; en elk gebruik dat misbruik- of deliverabilityrisico materieel verhoogt.
6.2 NovaMX mag dergelijk gebruik weigeren of schorsen, ook wanneer het niet elders in dit beleid expliciet verboden is.
7. Wet- en regelgeving
7.1 U moet voldoen aan toepasselijke wet- en regelgeving in Nederland, de Europese Unie, en elk rechtsgebied waar uw content of ontvangers zich bevinden. Dit omvat privacyrecht (AVG), regels voor elektronische communicatie, consumentenbescherming waar van toepassing, intellectueel eigendomsrecht, en export- en sanctieregels.
7.2 U mag diensten niet gebruiken ten behoeve van personen, entiteiten of landen die onderworpen zijn aan EU-, VN-, VS- of andere toepasselijke sancties wanneer het leveren van de dienst die beperkingen zou schenden.
8. Klantcontent en derden
8.1 U bent verantwoordelijk voor alle content, DNS-records, e-mail, applicaties en data die op of via uw NovaMX-diensten worden geplaatst of verzonden, inclusief content geüpload door uw werknemers, contractanten, eindgebruikers, of iedereen aan wie u toegang verleent.
8.2 U zorgt ervoor dat subgebruikers en derden die namens u handelen dit beleid naleven. NovaMX is niet verantwoordelijk voor door klanten gegenereerde content, maar kan ingrijpen wanneer misbruik wordt gemeld of gedetecteerd.
9. Beveiliging en misbruikpreventie
9.1 U houdt inloggegevens veilig, installeert tijdig beveiligingsupdates voor software die u beheert, en configureert DNS en mailauthenticatie zorgvuldig.
9.2 U probeert geen andere systemen te onderzoeken, scannen of compromitteren vanaf NovaMX-infrastructuur. Meld vermoede compromittering of misbruik van uw account snel bij NovaMX via abuse@novamx.eu of via het klantportaal.
10. Toezicht en handhaving
10.1 NovaMX mag gebruik van diensten, netwerkverkeermetadata, misbruikmeldingen, mailreputatiesignalen, en publieke DNS-gegevens monitoren om infrastructuur te beschermen, aan de wet te voldoen, en dit beleid te handhaven. NovaMX garandeert geen doorlopende inhoudelijke controle van alle klantgegevens.
10.2 Wanneer NovaMX een overtreding vaststelt of redelijkerwijs vermoedt, mag NovaMX: waarschuwen; remediatie eisen; verkeer filteren of blokkeren; diensten rate-limiten; domeinen, hosting, mail of portaaltoegang schorsen; registratie- of verhuisacties tegenhouden; diensten beëindigen; en activiteit melden aan registrars, CERT-teams, hostingpartners of bevoegde autoriteiten waar vereist of passend.
11. Schorsing en beëindiging
11.1 NovaMX mag diensten onmiddellijk schorsen of beëindigen bij ernstige overtredingen, wettelijke verplichting, gerechtelijke bevelen, registrarbeleid, betalingsachterstand gecombineerd met misbruikrisico, of herhaalde kleinere overtredingen.
11.2 Waar redelijk probeert NovaMX de accounthouder te informeren en tijd te geven om niet-urgente problemen op te lossen. Restitutie na beëindiging om reden volgt de Voorwaarden en toepasselijk recht.
12. Wijzigingen
12.1 NovaMX mag dit beleid bijwerken om wettelijke, technische of productwijzigingen te weerspiegelen. Materiële updates worden gepubliceerd onder een nieuw versie-identificatienummer. Voortgezet gebruik van diensten na publicatie geldt als aanvaarding van het bijgewerkte beleid, tenzij de wet anders vereist.

15.1 Dit beleid wordt beheerst door hetzelfde recht en dezelfde bevoegde rechter als de NovaMX Voorwaarden.
15.2 De Engelse tekst van dit beleid is doorslaggevend. De Nederlandse tekst is ter informatie; bij strijdigheid prevaleert de Engelse tekst.
